The petitioner seeks an order of interim injunction restraining the respondent from either alienating or encumbering the properties subject matter of the suit in O.S.No.89 of 2022 on the file of the I-Additional District and Sessions Judge, Vellore. The suit was laid by the petitioners for partition and separate possession of their 3/4th share in the suit properties.

2.The Trial Court, on a consideration of the evidence on record concluded that the suit properties were settled in the name of the defendant by the mother, it becomes the absolute properties of the defendant and therefore, the plaintiffs are not entitled to share in the suit properties.

3.Any alienation, pending appeal would be subject to the result of the appeal. Hence, we see no necessity for grant an order of injunction. This petition is therefore, dismissed.
