This petition has been filed to condone the delay of 84 days in filing the CMA.

2. Though notice has been sent to the respondents on 24.08.2023, it appears that affidavit of service to the 1st respondent is not filed. However, it is submitted by the learned counsel for the petitioner that the first respondent has already set as ex-parte before the trial court. Hence, notice to the first respondent may be dispensed with.

3.In view of the submission made by the learned counsel for the petitioner, notice to the 1st respondent is dispensed with.

4. The affidavit filed in support of this petition has been perused and on being satisfied with reasons stated therein, this Court is inclined to condone the delay.

5. Accordingly this petition is allowed. However, it is made clear that the claimant is not entitled for interest on the compensation for the period of delay.
