To condone the delay of 2491 days caused in filing the application to set aside the abatement caused due to the death of the deceased respondent C.Sippoy in the above S.A.No.1149 of 2014.

PRAYER in CMP No.19118 of 2023:

To set aside the abatement of abatement of the above S.A.No.1149 of 2014 as against the respondent and to bring the respondents 4 to 8 as legal representatives of the deceased respondent C.Sippoy. PRAYER in CMP No.19120 of 2023:

To bring on record the legal heirs of the deceased respondent. For Petitioner :Mr.V.S.Jagadeesan For R1 : Died R2 & R3 : Served/ No appearance R4 to R8 : Mr.S.Kaithamalai Kumaran 2/6

ORDER

These civil miscellaneous petitions have been filed (i) To condone the delay of 2491 days caused in filing the application to set aside the abatement caused due to the death of the deceased respondent C.Sippoy in the above S.A.No.1149 of 2014.

(ii) To set aside the abatement of abatement of the above S.A.No.1149 of 2014 as against the respondent and to bring the respondents 4 to 8 as legal representatives of the deceased respondent C.Sippoy. (iii) To bring on record the legal heirs of the deceased respondent. 2.Heard the learned counsel for the petitioner and the learned counsel for the respondents who submits that he has got no serious objection in allowing these petitions.

3.Considering the reasons stated in the affidavits filed in support of these petitions, these petitions are allowed. Registry is directed to carry out necessary amendments in the cause title.
