This Criminal Original Petition has been filed seeking for a direction to transfer the investigation from the second respondent to some other investigating agency as there is not much progress in the investigation pending in Crime No. 4 of 2013 on the file of the second respondent herein. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent.
3.Whenever any information in relation to commission of cognizable or non cognizable offence is received, the police officer shall adhere to the procedure contemplated under Sections 154 & 155 of the Criminal Procedure Code and after https://hcservices.ecourts.gov.in/hcservices/
conducting necessary enquiry/investigation, file final report under Section 173 of Cr.P.C. Such investigation under Chapter XII of the Criminal Procedure Code shall be completed without any unnecessary delay. The delay in filing a final report in the present case is inordinate and unjustified. Hence, it would be appropriate to direct the Investigating Officer to file a final report within a stipulated time.
4. Further, in my view, considering the facts of the case, it would be appropriate to direct the superior authority to monitor the investigation.
5. In the result, there shall be a direction to the Second respondent herein who is the Inspector of Police, Meppedu Police Station, Manavala Nagar Circle, Thiruvallur District, to complete the investigation in Crime No.4 of 2013 and file the final report within six weeks from the date of receipt of copy of this order. Such an investigation shall be monitored by the Superintendent of Police, Thiruvallur District.
6. In the result, the Criminal Original Petition is ordered with the above directions. No Costs. Consequently, connected miscellaneous petition is closed.
