Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents 1 to 3 to conduct an enquiry and to take stringent action as against the fourth respondent for doing banking business without obtaining mandatory license under section 22 of the Banking Regulation Act, 1949 by considering the petitioner's representation dated 27.12.2021 within a time stipulated by this Hon'ble Court.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.A.Ilayaperumal, learned counsel for the petitioner, Mr.C.Mohan, learned counsel for the first respondent and Mr.A.Ilangovan, learned counsel for the fourth respondent.

2. The petitioner has not deposited the cost as directed under

the order dated 26.07.2023. Now, the motion is made for withdrawal of the writ petition. The prayer for withdrawal is made to circumvent the order passed by this Court directing the petitioner to deposit Rs.50,000/-.

3. However, as request is made for withdrawal of the writ petition, the writ petition is dismissed as withdrawn.

4. In case the petitioner files any fresh writ petition, though the Registry cannot refuse to accept the filing of the writ petition, however, if the matter is sought for listing, the present order of the petitioner not depositing the amount of Rs.50,000/- as directed shall be brought to the notice of the Court.

5. There will be no order as to costs.
