This petition is filed under Section 5 of the Limitation Act, to condone the delay of 164 days in filing the Criminal Appeal against the Judgment, dated 05.12.2022 in Spl.C.C.No.1 of 2019 on the file of the learned Sessions Judge, Magalir Neethimandran (FTMC), Udhagamandalam at Nilgiris.
2. Mr.S.Sugendran, learned Additional Public Prosecutor appearing for the respondent did not raise any serious objection in allowing this petition and this Court is satisfied with the reasons assigned in the affidavit filed in support of this petition. Hence, the petition is allowed.
