The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Section 6(4) of TN Scheduled Commodities (RDCS) Order, 1982 and Section 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.10 of 2023, on the file of the respondent police, seeks anticipatory bail.

It is the submission of the learned counsel for the petitioner that petitioner is an innocent person and he has been falsely implicated in Crime No.10 of 2023 for the alleged offences under Section 6(4) of TN Scheduled Commodities (RDCS) Order, 1982 and Section 7(1)(a)(ii) of Essential Commodities Act, 1955.

3.In response, the learned Government Advocate (Crl.side) submitted that on 22.02.2023, at about 23.00 hours, when the respondent police were in routine vehicle check up, in Chengam Bye-pass Pudhupalayam Kooturoad to Chengam road, they found a vehicle bearing registration No. TN97C2445. On seeing the police, driver of the vehicle

tried to escape. He was apprehended and on search, it was found that there was 14 plastic bags of 50 Kgs each of PDS rice. There was no valid permit for transportation of the PDS rice. He further submitted that petitioner has one previous case of similar nature pending against him in Crime No.33 of 2023. Thus, he prayed for dismissal of this petition. 4.Considering the fact that the rice which is meant for Public Distribution System was illegally transported and that petitioner has one previous case of similar nature pending against him and also the fact that investigation in this case is also not completed, this Court is not inclined to grant anticipatory bail for the petitioner. 5.Accordingly, this Criminal Original Petition is dismissed. 31.07.2023 sli
