ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under section 294(b), 147, 148, 448, 394 and 506(ii) of IPC, in Crime No.389 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that there was civil dispute pending between the parties. It is alleged that A2 and the wife of A1 consented to purchase a property belonging to the sisterin-law of the defacto complainant and thereby entered into a memo of understanding and the balance amount to be settled by the accused is Rs.2,11,00,000/-. While so the petitioners along with other accused attacked and abused the father of the defacto complainant and caused serious injuries to him. Hence the law enforcing agency registered a case against the petitioners.

3. The learned counsel for the petitioners submits that the matter was civil in nature. He further submits that 15 days almost completed and the petitioners did not committed any offence as alleged by the prosecution. Hence he prays for grant of anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl.Side) submits that this is the second anticipatory bail petition filed by the petitioners. Considering the previous cases pending as against the petitioners, this Court dismissed the earlier anticipatory bail application in Crl.O.P.No.17581 of 2021 dated 27.09.2021. However, he vehemently opposed for grant of anticipatory bail to the petitioners.

5. Taking into account that there are two previous cases pending against A1 and three previous cases pending against A2 and also the earlier anticipatory bail petition was dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 27/10/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
