Respondents Prayer: Petition is filed under Article 226 of the Constitution of India praying to issue a writ of mandamus, directing the 3rd and 4th respondents to regularize the services of the petitioner in the permanent post of office assistant with effect from the date of initial appointment in the regular time scale of pay with all monetary and attendant benefits, in the light of the order passed by this Honourable court in W.P.No.18126/2008 dated 29.07.2008 and G.O.MS.111 dated 09.05.2012.

Heard the learned counsels appearing on behalf of the parties concerned.

At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the respondents had submitted that the petitioner may be directed to give a fresh representation to the 2nd respondent, with regard to his claim, for regularization of his service. The learned counsel had also submitted that such representation would be considered by the 2nd respondent and appropriate orders would be passed thereon, as expeditiously as possible.
3. The learned counsel appearing on behalf of the petitioner has no objection for such an order being passed by this Court.
4. In view of the submissions made by the learned counsels appearing on behalf of the parties concerned, the petitioner is directed to give a fresh representation to the 2nd respondent, with regard to his claim, for regularization of his service, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the 2nd respondent is directed to consider the same and pass appropriate orders thereon, within a period of twelve weeks thereafter, after giving an opportunity of hearing to the petitioner, and the other persons concerned, if any. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.
5. Accordingly, the Writ Petition is disposed of, with the above directions. No costs. M.P.No.1 of 2012 is closed. gs.
