Full Gospel Pentecostal Church v. The Government Of Tamil Nadu
C.M.P.No.16721 of 2022 in W.A.No.SR 90001 of 2022 C.M.P.No.16721 of 2022 in W.A.No.SR 90001 of 2022 THE HON'BLE ACTING CHIEF JUSTICE and D.KRISHNAKUMAR, J.
(Order of the Court was made by The Hon'ble Acting Chief Justice) C.M.P.No.16721 of 2022 has been filed seeking to condone the huge and unexplained delay of 141 days in filing the writ appeal. The learned single Judge, by order dated 29.10.2021, has dismissed the Writ Petition No.29074 of 2011 holding that the writ petitioner, without getting any approval from the competent authority, cannot convert the residential building as Pentecostal Church for the purpose of providing gospel services. Since the petitioner failed to file the appeal within a reasonable time, the delay of 141 days has occurred. A litigant, who is coming to the Court seeking an order to condone the delay, is bound to explain every day's delay with sufficient cause. In the case on hand, not even a day's delay has been explained, leave alone the sufficient cause. Therefore, we are unable to condone the delay. Accordingly, the civil miscellaneous petition stands dismissed.
