Respondents PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code praying to call for the records of the Inspector of Authur Town Police Station, the 1st respondent herein dated 24.02.2019 in C.No.06/fh/M-M/efu/fh/ep-2019 and signed by him on 24.02.2019 and quash the same and give directions to the 2nd respondent, the Deputy Superintendent of Police, Authur, Salem District to carry out the investigation on the complaint dated 06.12.2018 preferred by V.Kundukannan, the petitioner

herein in the proper manner and also instruct the Superintendent of Police, Salem District, the 3rd respondent herein to monitor the same.

O R D E R

(through Video Conference) This Criminal Original Petition has been filed seeking for a direction, to call for the records of the 1st respondent herein dated 14.02.2019 in C.No.06/fh/M-M/efu/fh/ep-2019 and quash the same and give directions to the 2nd respondent, the Deputy Superintendent of Police to carry out the investigation on the complaint dated 06.12.2018 preferred by the petitioner herein in the proper manner and also instruct the Superintendent of Police, Salem District, the 3rd respondent herein to monitor the same.

2.In spite of repeated adjournments, neither the petitioner nor his counsel has appeared before this Court. Though this Petition is posted under the caption "For Orders", there was no representation from the Petitioner. Heard Mr.S.Karthikeyan, learned Additional Public Prosecutor appearing on behalf of the respondents 1 to 5.

3.Today, when the petition is came up for hearing, the learned Additional Public Prosecutor appearing on behalf of the respondents 1 to 5, on instructions, would submit that in respect of the complaint dated 06.12.2018 given by the petitioner, the first respondent herein registered the case in Cr.No.21 of 2019 under Section 174 of Criminal Procedure Code, and after investigation, he filed a final report on 21.01.2019 as further action dropped. Further, in respect to the filing of final report, R.C.S. Notice in S.No.2 of 2019 has also served to the petitioner on 22.01.2019.

4.Hence, in view of the above, nothing survives for further adjudication in this petition and accordingly, this Criminal Original Petition is closed.
