The petitioners, apprehend arrest at the hands of the respondent police for the offences punishable under Section 6(4) of the TN Scheduled Commodities (RDCS) Order 1982, Section 7(1)(a)(ii) of Essential Commodities Act, 1955 in Crime No.108 of 2022, seek anticipatory bail.

2. Heard both sides.

3. The case of the prosecution is that the petitioners were in illegal possession of 30,000 kgs of PDS Rice without any permission or license. Hence, the complaint.

4. The learned Government Advocate (Criminal Side) appearing for the respondent would submit that this is the fourth anticipatory bail petition. Earlier petitions filed by the petitioners before this Court in Crl.O.P.No.10515 of 2022, Crl.O.P.No.11321 of 2022 and Crl.O.P.No.12385 were dismissed on 05.05.2022, 18.05.2022 and 07.06.2022 respectively. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

Considering the huge quantity of essential commodities seized and taking note of the fact that this Court had dismissed the earlier petitions filed by the petitioners on three occasions and again and again, the petitioner repeatedly approached this Court for anticipatory bail without surrender. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
