ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of Mandamus directing the second respondent to consider petitioner's representation dated 04.06.2026 and direct the third respondent to rectify the legal heir certificate TN-7202602211744 dated 08.05.2026 by inserting petitioner's brother name Mr.Aslam as legal heir and issue the rectified Legal Heir Certificate.

At the outset, learned counsel for respondents would submit that petitioner's prayer for rectification of legal heir certificate would be treated as an appeal in terms of G.O.Ms.No.478, Revenue and Disaster Management, Revenue Administration Wing, RA-3(2) Section dated 29.09.2022, and accordingly petitioner's representation dated 04.06.2026 would be considered and appropriate orders would be passed after issuing notice and after affording reasonable opportunity of hearing to petitioner, Mr.Aslam and other interested parties. Agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondents to consider the representation dated 04.06.2026 in terms of G.O.Ms.No.478 dated 29.09.2022, on its own merits and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioner, Mr.Aslam and any other interested persons within a period of eight (8) weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
