PRAYER: This criminal original petition filed under Section 528 of BNSS to issue directions to the Learned Special Court for SC/ST (PoA) Act cases, Vellore to consider the petitioner's bail application on surrendering before the said court on the same day in Crime No.125 of 2026 pending investigation on the file of the 2nd respondent and thereby render justice. ORDER

This Criminal Original Petition has been filed seeking a direction to the Learned Special Court for SC/ST (PoA) Act cases, Vellore to consider the petitioner's bail application on surrendering before the said court on the same day in Crime No.125 of 2026 pending investigation on the file of the 2nd respondent.

2.On perusal of the complaint, it is seen that the third respondent/victim is a B.Pharm graduate and is working as a pharmacist in a medical shop at Gudiyatham. On 03.06.2026, he, along with his friends, had gone to participate in Paratharami Gangaiamman Festival. Since the temple was crowded, the third respondent had stayed inside the temple for some time and later he came out.

On seeing him, the petitioners and others, who belong to Anganaampalli Village and Most Backward Community, called him and took him to a private building, where, they abused him stating that how dare, a schedule caste person can enter the temple for worship. Thereafter, they beat him black and blue. Thereafter, at the intervention of the relatives and villagers, he was saved. The third respondent/victim was admitted to the hospital and was given 5 sutures on his eyebrow. But for the third respondent /victim ducking, his eyesight would have been affected. Hence lodged a complaint.

3.Heard the learned Additional Public Prosecutor for respondents 1 and 2 and perused the materials on record.

4.In view of the above factual position, there shall be a direction to the Learned Special Court for SC/ST (PoA) Act cases, Vellore, to consider the petitioners' bail application, preferably on the same day of their surrender, in connection with Crime No.125 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
