ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.03.2026 for the alleged offences under Sections 406 and 420 IPC in Crime No.58 of 2025 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that the petitioner has been remanded in judicial custody on 04.03.2026 and for more than 99 days he

has been incarcerated.

At this juncture, the learned Government counsel (Criminal Side) submitted initially he has been enlarged on bail in Crl.OP.No.9633 of 2025 dated 02.04.2025 with a condition to deposit Rs.3,00,000/- to the credit of Crime No.58 of 2025. However, due to non-compliance of deposit, bail was cancelled. Subsequently, he has been remanded in judicial custody on 04.03.2026.

4. It is the contention of the learned counsel for the petitioner that the petitioner found it difficult to deposit such amount.

5. At this juncture, the learned Government Advocate, opposed the bail application on the ground that the petitioner has received Rs.10 lakhs from the de facto complainant under the pretext of getting job in Secretariat. Hence, he opposed the grant of bail to the Petitioner.

6. I have given my anxious consideration to either side submissions and perused the materials available on record.

7. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); it is

observed that the allegation against this petitioner is serious in nature, however, considering the long period of incarceration of the petitioner, and upon the fact that the petitioner was behind the Bar for two months, from March 2025 to April 2025, was remanded again on 04.03.2026 and remains behind the bars till date, this Court is of the firm view that further custody of the petitioner is not required for the purpose of investigation. Hence, this Court is inclined to enlarge the petitioner on bail, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned II Metropolitan Magistrate, Egmore Court, Chennai, and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders; [c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial;

[e] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
