ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 394 and 397 IPC in Cr.No.38 of 2021, on the file of the respondent police seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused persons have threatened the defacto complainant with knife point and robbed 1 sovereign gold chain from him. Thereby, the law enforcing agency registered a case against the petitioner. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence he prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) submitted that the property has been recovered by the law enforcing agency and there are three previous cases similar nature pending against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and though the property has been recovered by the law enforcing agency, considering the previous cases pending against the petitioner, this court is not inclined to grant anticipatory bail to the petitioner.
