This Criminal Original Petition has been filed to withdraw the charge sheet in C.C.No.844 of 2022 pending on the file of the Judicial Magistrate Court No.3, Salem and to transfer the same to any other competent court
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first respondent-Police and perused the materials available on record.
3. Since no adverse order is being passed as against the private respondents, notice to the private respondents is dispensed with.
4. On a perusal of the records, it is seen that the grounds taken by the petitioner are not the grounds for transfer of case. This Court is not inclined to grant the relief as sought for by the petitioner in this petition. However, since the CC of the year 2022, the learned Judicial Magistrate No.III, Salem is directed to expedite the trial and dispose of the same in accordance with law.
5. With the abovesaid direction, this Criminal Original Petition is dismissed.
