Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to pay the subsistence allowance on month to month basis till final orders is passed in the pending disciplinary enquiry.

With the consent of both sides, this Writ Petition has been taken up for disposal at the admission stage itself.

2. This Writ Petition is filed for directing the respondents to pay the subsistence allowance to the petitioners.

3. The petitioners, who were working as Supervisors, Salesmen, and Assistant Salesmen in the respondents/Corporation, were suspended from service on various allegations by order dated 07.05.2024. However, they have not been paid subsistence allowance so far. 2/5

4. The learned Standing Counsel appearing for the respondents submitted that the petitioners were entitled to subsistence allowance during the period of their suspension. Pursuant to the order of suspension, they were also issued with a charge memo for initiating disciplinary proceedings.

5. In view of the submissions of the learned counsel on either side, the second respondent is directed to pay subsistence allowance, along with arrears, if any, forthwith.

6. With the above directions, this Writ Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed. No costs. 31.07.2024 2/2 Index:Yes/No kv 3/5
