The learned counsel for the petitioner submitted that the petitioner would be satisfied in case the matter is referred to mediation. The learned counsel therefore wanted an order to direct the learned trial Judge to refer the parties to mediation instead of transferring the matter.

I have also heard the learned counsel for the respondent. The learned counsel has no objection for referring the parties to mediation by the Sub Court, Madurantagam. 3.

In view of the submission made by the learned counsel for the petitioner, the Transfer Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed. https://hcservices.ecourts.gov.in/hcservices/

The learned Subordinate Judge, Madurantagam, is directed to refer the parties to mediation. The question of taking up the matter for trial or passing orders on merits, would arise only in case the parties failed to settle the matter. It is open to the parties to approach this Court in case further directions are necessary in the matter.
