Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 1st respondent herein to consider the petitioner's Representation dated 15.05.2025 sent for rectifying the mistake occurred during UDR Scheme in respect of the petitioner's and his family members' lands measuring 1.49 Acres in Old S.F.No.602 situate at Begapalli Village, Hosur Taluk, Krishnagiri District in accordance with law and within a stipulated period. ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the nature of the order that is going to be passed in this writ petition, notice to the respondents 2 to 10 is dispensed with.
2. The relief sought in this writ petition is to direct the 1st respondent to consider the petitioner's Representation dated 15.05.2025 for rectifying the mistake under UDR Scheme in respect of the property owned by the petitioner and his family members measuring an extent of 1.49 Acres 2/7
comprised in Old S.F.No.602 situated at Begapalli Village, Hosur Taluk, Krishnagiri District, in accordance with law and within a stipulated period.
3. The brief facts of the case are that the petitioner's father Late Mr.Devayya @ Devappa purchased the subject property under a Sale Deed dated 14.10.1959 registered as Document No.3868/1959 on the file of Sub Registrar Office, Hosur.
3.1. Petitioner's father died intestate on 13.09.1972 leaving behind his wife Mrs.Beeramma (deceased), two sons viz., Nagappa (deceased) and Sampangi (petitioner), daughter viz., Munirathnamma and three grandchildren viz., N.Suma, N.Suba and N.Sunith (children of deceased Nagappa) as his legal heirs to succeed his estate. After the demise of petitioner's father, his legal heirs were in joint possession and enjoyment of the subject lands.
3.2. While so, when the petitioner and his family members desired to partition the subject lands by metes and bounds, they found that the subject lands have been erroneously sub-divided as S.F.Nos.602/2-6 during UDR 3/7
Scheme and Pattas in respect of the subject property were erroneously issued in the name of respondents 2 to 10. Therefore, the petitioner made a Representation dated 15.05.2025 to the 1st respondent, requesting to rectify the mistake under UDR Scheme in respect of subject lands and issue Patta in the name of petitioner's family members in respect of the subject lands. However, the petitioner's Representation was not considered by the 1st respondent. Hence, the present writ petition.

The learned counsel for the petitioner submitted that during the UDR scheme, the subject lands were erroneously sub-divided and Pattas in respect of the subject lands were erroneously issued in the name of respondents 2 to 10. It is submitted that the respondents 2 to 10 are strangers and they have no right over the lands belonging to the petitioner and his family members.
4.1. It is further submitted by the learned counsel for the petitioner that the petitioner's Representation dated 15.05.2025 was duly served on the 1st respondent, but, till date, the same was not considered by the 1st respondent.

5. The learned Special Government Pleader appearing for the 1st respondent submitted that the 1st respondent would consider the petitioner's Representation and pass appropriate orders, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for the petitioner.

In view thereof, this Writ Petition stands disposed of with the direction to the 1st respondent to consider the petitioner's Representation dated 15.05.2025, after issuing notice to the petitioner, other legal heirs of Late Mr.Devayya @ Devappa, respondents 2 to 10 and all other interested parties including rival claimants, if any, within a period of twelve weeks from the date of uploading of the web copy of this order without waiting for the receipt of a certified copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. No costs.
