Sec.401 of Criminal Procedure Code to set aside the judgment of dismissal passed in Crl.A.No.4 of 2021 on the file of the learned Additional District and Sessions Judge, Dharmapuri dated 27.07.2021 and the judgment and conviction passed in C.C.No.14/2018 on the file of the learned Fast Track Court (Magistrate Level), Dharmapuri, Dharmapuri District by an order dated 05.01.2021. ORDER

When the matter came up for hearing, both the complainant and the accused were present before this Court.

The complainant submits that he has received the amount as full quit and a joint memorandum of compromise is also filed to that effect. 3.

In view thereof, this criminal revision is disposed of and the conviction of the petitioner/ M. Mallika for an offence under Section 138 of Negotiable Instruments Act, 1881 and the sentence imposed on the petitioner by the learned Judicial Magistrate, Fast Track Court, Dharmapuri, vide judgment dated 05.01.2021 in C.C.No.14 of 2018 and confirmed by the learned Additional Sessions Judge, Dharmapuri, vide judgment dated 27.07.2021 in Crl.A.No.4 of 2021 is hereby set aside and the offence is treated to have been compounded between the parties.

Accordingly, this Criminal Revision is disposed of in terms of the joint memo of compromise filed, which shall form part of this order. Consequently, connected miscellaneous petitions, if any stands closed. There shall be no order as to costs.
