PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to consider and conduct enquiry under Section 68 & 69 of the Registration Act, 1908 on the petitioner's complaint dated 04.07.2024 regarding abuse of statutory power and registration of fraudulent Document Nos.3277/2018 and 3278/2018 registered at the Annanagar Sub Registrar Office, Chennai within a time frame fixed by this Court and pass orders.

ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to respondent No.3 is dispensed with.

The present writ petition is filed praying for a writ of mandamus to direct the respondents 1 and 2 to conduct enquiry under Section 68 & 69 of the Registration Act, 1908 on the petitioner's complaint dated 04.07.2024 regarding abuse of statutory power and registration of fraudulent Document Nos.3277/2018 and 3278/2018 registered at the Annanagar Sub Registrar Office, Chennai within a time frame fixed by this Court.
3. The learned counsel for the petitioner would place reliance on the communication of the second respondent in KA.No.32078/R3/2024 dated 30.05.2025, wherein it is stated that an enquiry has 2/5
already commenced on the petitioner's complaint dated 04.07.2024.

On this being pointed out, learned Special Government Pleader for the respondent 1 and 2 would submit that though the said complaint prima facie does not appear to have merit, since a communication dated 30.05.2025 has been issued on the above complaint, the respondent authority would take the enquiry to its logical conclusion and decide the matter in accordance with law, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondents 1 and 2, to complete the enquiry on the basis of the complaint dated 04.07.2024 on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner, third respondent and any other interested persons/rival claimants, within a period of twelve (12) weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its 3/5
own merits and in accordance with law.
6. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
