..Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, to direct the 3rd respondent to mutate patta in the name of the petitioner in respect of the property viz., land comprised in Survey No.90/2, measuring an extent of 4 Acres and 27 cent, Survey No.90/6, measuring an extent of 2.5 cents and in Survey No.90/9, measuring an extent of 2 Acres and 92 cents altogether measuring a total extent of 7 Acres and 11 1⁄2 cents of land at Othiyathur Village, Gengavalli Taluk , Salem District.

O R D E R

The petitioner herein seeks a direction to 3rd respondent to effect mutation of revenue records in the name of the petitioner in respect of land comprised in Survey Nos.90/2, 90/6 and 90/9 situated at Othiyathur Village, Gengavalli Taluk , Salem District.

2. It is asserted by the petitioner that he submitted a representation dated 17.05.2023 to 3rd respondent seeking mutation of revenue records in respect of the above survey numbers.

3. A perusal of the representation would suggest that petition mentioned Survey No.90/14 is not all mentioned in the writ prayer. When the said discrepancy pointed out to the learned counsel for the petitioner, he submitted that petitioner would submit a fresh representation and the respondent may be directed to consider the same. The said statement made by the learned counsel for the petitioner is recorded.

Accordingly, the petitioner is directed to file a fresh representation regarding mutation of revenue records to the 3rd respondent within a period of two weeks from the date of receipt of copy of this order. On submission of the said representation, the 3rd respondent is directed to consider the same and pass final orders after issuing notice to the interested parties within a period of eight weeks thereafter. The petitioner is also directed to pay necessary charges for surveying the property as demanded by the respondents.
