ORDER

The Writ Petition is filed seeking for the following relief; "for a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 30.12.2021 in the light of the Judgment made in W.A. No.192 of 2020 dated 10.08.2021 and to upgrade the petitioner to the post of Record Assistant with effect from 02.03.2009 and disburse all the consequential monetary benefits payable to the petitioner forthwith, in accordance with law, on merits expeditiously within a stipulated time may be fixed by this Court."

2.The case of the petitioner is that the petitioner was recruited and appointed as Night Watchman in Government High School, Eengoor, Erode District on 10.10.1988 and subsequently promoted to the post of Office Assistant on 23.11.1990 and further promoted to the post of Record Clerk on 01.03.1999 and allowed to retire from service on attaining his superannuation on 31.12.2017.

3.It is the further case of the petitioner that since Record Clerks were continuing their service without any promotion, the Government issued orders and upgraded their post from the cadre of Record Clerk to Record Assistant. On completion of ten years in the post of Record Clerk or as per his seniority, the petitioner is entitled for upgradation as Record Assistant from 02.03.2009 onwards. But the Respondents denied the petitioner's claim and granted upgradation after a lapse of six years ie.., on 26.05.2015. It is also the case of the petitioner that as per the order of this Court made in W.A.No.192/2020, made in favour of the petitioner's colleagues, the petitioner is also entitled for upgradation from the post of Record Clerk to Record Assistant from 02.03.2009 onwards.

Therefore, the petitioner made a representation to the respondents on 30.12.2021 with a request to revise his promotion order and thereby promote him on par with his juniors notionally and to revise his pay. However, the representation of the petitioner is yet to be considered by the respondents. Hence, the petitioner has filed the present Writ Petition with the above said prayer.

4.Heard the learned counsel on either side and perused the materials available on record.

Considering the relief now sought for by the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 30.12.2021 and to pass orders, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
