The Criminal Original Petition is filed as against the order passed in Crl.M.P.No.140 of 2025 dated 13.06.2025 in Crl.M.P.No.2437 of 1/5

2024 by the Special Judge, Special Court under TNPID Act, Coimbatore.

2. Heard the learned counsel on either side and perused the materials available on record.

It is seen that the petitioners/A5 and A7 are arrayed in Crime No.2 of 2024 for the offences punishable under Sections 120-B, 420 and 406 IPC and Section 5 of the TNPID Act, 1997 and they had been arrested and remanded to judicial custody and subsequently, the petitioners had been enlarged on bail on certain conditions in Crl.M.P.No.2437 of 2024 dated 13.11.2024 by the learned Special Judge, Special Court under TNPID Act, Coimbatore. Subsequently, the petitioners filed a petition in Crl.M.P.No.140 of 2025 invoking Section 483(b) of the BNSS and sought for relaxation of the conditions imposed on them in Crl.M.P.No.2437 of 2024 by order dated 13.11.2024. The learned Special Judge, vide order dated 13.06.2025 dismissed the petition and as against the said order, the present petition has been filed. 2/5

A reading of the entire materials would reveal that the petitioners herein and others had enticed the general public and had received huge sums of money and defrauded them and that the defrauded amount runs about Rs.4.55 Crores. The submission of the learned Government Advocate (Crl.Side) would reveal that the investigation is under progress and charge sheet has not yet been filed and hence, considering the nature of the offences and also considering the stage of the investigation, this Court is not inclined to interfere with the order of the Court below. Therefore, the Criminal Original Petition is dismissed. 08.07.2025 ms 3/5
