The Petitioner/A2, who apprehends arrest at the hands of the Respondent police for the offence punishable under Sections 408, 420, 465, 467, 468, 471, 477A r/w 120B of IPC in Crime No.159 of 2023 on the file of the Respondent police, seeks anticipatory bail. 2.The wife of the Petitioner along with three accused are working in the firm of the Defacto complainant, who is said to have been doing Dhal business and the Accused have been entrusted to the work of maintaining the accounts of the firm. Based upon the confession statement of the first Accused, who is the wife of the Petitioner, the Petitioner herein was arrayed as A2. 3.As per the prosecution, when the Defacto Complainant went through the bank statement they found that the payment has been made to unknown names and amount writing on carbon leaf is of much less amount and therefore, they conducted an internal audit from that, it came to light that when Defacto Complainant as well as the family members were not present in the office, the accused have taken NEFT key and made huge payments through 1/ 4
NEFT to people not relevant to their business for the financial year 2022-2023. According to the prosecution totally the accused have misappropriated a sum of Rs.6 crores.
3.The learned Counsel for the Petitioner would submit that the Petitioner is no way connected with this crime and he was falsely implicated in this case, based upon the confession statement given by his wife. 4.The learned Government Advocate (Criminal Side) for the Respondent submitted that the matter is under investigation and notice under Section 41(A) of Cr.P.C. also sent to the Petitioner, eventhough the Petitioner has not appeared for the enquiry.
5.Heard both sides and perused the materials available on record. 6.Taking into consideration the facts and the submissions made by the learned counsel on either sides and the nature and gravity of the offence and the fact that the investigation is at the preliminary stage, this Court is not inclined to grant anticipatory bail to the Petitioner. 2/ 4
7.Accordingly, this Petition is dismissed.
