Respondents PRAYER: Writ Petition has been filed under Article 226 of the Constitution of India seeking a Writ of Certiorarified Mandamus, to call for the records of the order passed by the 2nd respondent in Ref.No.RC/SSP/Vig/04-05/05, dated 02.08.2007 and as confirmed by the first respondent in his proceedings No.RC/SSP/CV/05/09, dated 02.11.2007 and quash the same and consequently direct the respondents to promote the petitioner in the post of Senior Manager with effect from 30.06.2001 and to the post of E6 Grade with effect from 30.06.2005 on par with his juniors with all consequential and attendant benefits including arrears of salary with interest and to consider further promotion to the post of E7 grade in accordance with seniority. This Writ Petition has been filed for the issuance of Writ of Certiorarified Mandamus, to call for the records of the order passed by the 2nd respondent in Ref.No.RC/SSP/Vig/04-05/05, dated 02.08.2007 and as confirmed by the first respondent in his proceedings No.RC/SSP/CV/05/09, dated 02.11.2007 and quash the same and consequently direct the respondents to promote the https://hcservices.ecourts.gov.in/hcservices/
petitioner in the post of Senior Manager with effect from 30.06.2001 and to the post of E6 grade with effect from 30.06.2005 on par with his juniors with all consequential and attendant benefits including arrears of salary with interest and to consider further promotion to the post of E7 grade in accordance with seniority.
2. When the matter came up for hearing today, the learned counsel appearing for the petitioner would submit that since the dispute relates to continuation of service for an employee employed by the Steel Authority of India, the same has to be transferred to the Central Administrative Tribunal, in light of the Notification No.S.O.727(E), dated 31st March, 2010.
3. The said submission is not disputed by the learned counsel appearing for the respondents.
4. In view of the submission made by the learned counsel appearing for both sides, Registry is directed to transfer the case to the Central Administrative Tribunal.
5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
