The 2nd respondent / driver is no more and there is no liability fastened on him. The learned counsel for the appellant has given up the appeal against the 2nd respondent, since there is no relief claimed against him. The other respondents are served and represented by counsels.

2. The learned counsel for the 1st respondent / claimant would submit that no reasons have been given for the delay and therefore, the delay should not be condoned. However, a perusal of the affidavit filed in support of the condone delay petition would indicate the reasons for the delay and the same appears to be sufficient. Accordingly, the delay is condoned.

3. The Registry is directed to number the appeal, if otherwise in order. The Registry is also directed to print the name of the learned counsels for the respondents at the time of admission.
