ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 16.07.2021 for the offence punishable under Section 174(1) Cr.P.C and subsequently alter into 302 of IPC. Further, after completion of investigation the petitioner was charged for the offences under Sections 302, 201 of IPC and Section 75 of The Juvenile Justice Act, in P.R.C.No.67 of 2021 on the file of the Judicial Magistrate No.1, Villupuram, in Crime No.412 of 2021 on the file of the respondent police, seeks bail.
2. This is the fourth bail application filed before this Court. The case of the prosecution is that the petitioner being the step mother of the child, strangulated the neck of the child and killed her. Hence, the complaint.
3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and she has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate (Crl. Side) submitted that earlier bail applications were dismissed by this Court in Crl.O.P.Nos.13363, 14811 and 17387 of 2021 and there is no change of circumstances. He further submitted that the investigation has been completed and the charge sheet has also been filed. Hence, he vehemently opposed for grant of bail to the petitioner. 5.Considering the facts and circumstances of the case and also the fact that the petitioner has involved in very heinous offence, and earlier petitions were dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
6.Accordingly, this Criminal Original Petition is dismissed with a direction to the trial Court to complete the trial as expeditiously as possible.
