Criminal Original Petition filed under Section 439 of Criminal Procedure Code, to direct the respondents to transfer the investigation pending in connection with Cr.No.187 of 2019 on the file of the 2nd respondent police and to transfer some other agency or CBCID and to file the final report to the concerned Magistrate.

ORDER
Seeking direction to the respondents to transfer the investigation pending in connection with Cr.No.187 of 2019 on the file of the 2nd respondent police and to transfer some other agency or CBCID and to file the final report to the concerned Magistrate, the petitioner is before this Court. 2.The learned Additional Public Prosecutor would submit that further action was dropped on 13.06.2019 for Crime No.187 of 2019. Therefore, transfer of investigation does not arise, since no investigation is pending on the file of the 2nd respondent in Crime No.187 of 2019. Further it is submitted the referred charge sheet has already been served to the petitioner.

3. the above submission, the Criminal Original Petition is dismissed. However the petitioner is at liberty to file a protest petition before the concerned Court, in accordance with law, if so advised.
