ORDER

This application has been field by the defendants in Testamentary Original Suit seeking to set aside the order dated 02.06.2025 by which order they were set exparte.

2. In the affidavit filed in support of the Judges Summons, it had been contended that the suit was listed for filing written statement. But C.V. KARTHIKEYAN,J., https://www.mhc.tn.gov.in/judis

A.No.3648 of 2025 vum instructions had not been given to the counsel and there was a communication gap. It had been stated that however written statement had now been filed along with the application. Since bonafide had been expressed by filing written statement and also on hearing the learned counsel for the plaintiffs, the application stands allowed. The exparte order, dated 02.06.2025 is set aside.
