Respondents Prayer:- Writ petition filed under Section 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to a letter issued by the first respondent in Ref.CTBO/A-6502225, dated 13.07.2016, to quash the same and to scrutinise and process the application submitted by the petitioner to the first respondent (Reference No.A-6502225) without insisting for fresh No Objection Certificate from the 2nd respondent herein. O R D E R

The writ petition has been filed challenging the impugned order of the first respondent dated 13.07.2016 and for a direction to the first respondent to scrutinize and process the application submitted by the petitioner (Reference No.A6502225) without insisting for fresh No Objection Certificate from the 2nd respondent herein.

2. When the matter was taken up today, the first respondent has filed a counter stating that the petitioner has https://hcservices.ecourts.gov.in/hcservices/

obtained no objection certificate (NOC) from the 2nd respondent in the year 2014 and they require a valid no objection certificate for the year 2016 from the concerned authority for processing her application.

3. The learned counsel appearing for the petitioner would submit that the petitioner is prepared to send a representation to the second respondent for NOC and the second respondent may be directed to consider the said representation within a time frame.

4. In view of the above, this Court without going into the merits of the case, permits the petitioner to submit a representation to the second respondent for NOC within one week from the date of receipt of a copy of this order and the second respondent is directed to consider the same in accordance with law after affording opportunity of hearing to the petitioner and pass orders within a period of two weeks thereafter. If the order of NOC is passed by the second respondent, the first respondent thereafter shall consider the application of the petitioner and pass orders in accordance with law as expeditiously as possible. The writ petition is disposed of accordingly. Consequently, the connected miscellaneous petition is closed. No costs.
