2 MOHAMMED TANVEER Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the order dated 23.09.2021 and direct the 2nd respondent not to leave the jurisdiction of this Hon`ble Court, pending inquiry and trial in Cr.No. 4/2021 on the file of Inspector of Police, Vepery, All Women`s Police Station.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. BADER SAYEED, Advocate for the petitioner, and of MR.S.BALAJI, Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- This petition has been filed by the petitioner/defacto complainant to modify the order dated 23.09.2021 and direct the second respondent not to leave the jurisdiction of this Hon'ble Court, pending inquiry and trial in Crime No.4/2021 on the file of the Inspector of Police Vepery, All women Police Station.

2. Today, when the matter is taken up for hearing, the learned counsel for the petitioner filed the affidavit and he submitted that the petitioner got employment at Bahrain with much difficulty and he is the only breadwinner of his family. In order to harass the petitioner/accused, the defacto complainant has filed this modification petition. Hence, the learned counsel prays to dismiss https://hcservices.ecourts.gov.in/hcservices/

this petition.

3. The learned Government Advocate submitted that investigation completed and charge sheet filed in CC.No.63 of 2021 before the Additional Mahila Court, Egmore, Chennai and the matter has been adjourned on 23.12.2021 for the appearance of the accused. 4.In view of the fact that the petitioner has filed an affidavit and has undertaken that he will fully cooperated in the trial and also taking into consideration the fact that the petitioner is the only breadwinner of the family and his employment is necessary for sustenance of the family, this court is inclined to close the modification petition.

5. Recording the above statement, the this Modification Petition is closed.
