ORDER
The petitioner has filed this petition seeking a direction to the Sessions judge, Special Court for Trial of cases under Scheduled Castes and Scheduled Tribes (PA)Act, 1989, Tiruppur District to consider the petitioner's bail application on the same day of his surrender in connection with Crime No.21 of 2026 on the file of the second respondent police.
2. The case of the prosecution is that the de facto complaint and others were employed in a farm and were staying therein. On the night of 27.01.2026, the petitioner along with other persons entered the farm using a JCB vehicle and a Pickup vehicle and caused damage to the property. When the de facto complaint and others attempted to prevent the same, they were assaulted and abused by referring to their caste name.
3. The learned counsel for the petitioner submitted that the petitioner is not a named accused in the First Information Report and that his involvement in the alleged occurrence has been attributed solely on the basis of the confession statement of the co-accused during the course of investigation.
4. In view of the above factual position, there shall be a direction to the Sessions judge, Special Court for Trial of cases under Scheduled Castes and Scheduled Tribes (PA)Act, 1989, Tiruppur District to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No. 21 of 2026 on the file of the respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
