Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to cancel the TSLR extract issued in the name of the respondents 3 to 7 in respect of TS.No.39 and Old S.No.300/1, Block No.238 of Velachery Taluk, Velachery Village, measuring to an extent of 20 cents and restore the same in the name of the present owners M.Mr.M.Raju, 2.M.Muthukumar, 3.M.Karthick Kumar, surviving heirs of M.Muthusamy. ORDER

This Writ Petition has been filed seeking a direction to the respondents to cancel the TSLR extract issued in the name of the respondents 3 to 7 in respect of the property comprised in TS No.39 and Old S.No.300/1, Block No.238, measuring an extent of 20 cents, situated at Velachery Taluk, Velachery Village and to restore the same in the name of the present owners.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 & 2. Perused the materials available on record.

3. It is seen that the petitioner did not submit any appeal before the Revenue Divisional Officer for cancellation of the TSLR extract issued in favour of the respondents 3 to 7 herein.

Therefore, the petitioner is at liberty to submit a fresh application before the concerned jurisdictional Revenue Divisional Officer to cancel the TSLR extract issued in the names of the respondents 3 to 7 in respect of the property comprised in TS No.39 and Old S.No.300/1, Block No.238, measuring an extent of 20 cents, situated at Velachery Taluk, Velachery Village, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such application, the Revenue Divisional Officer, is directed to conduct an enquiry, after issuing notice to the petitioner as well as the counter parties and after affording them an opportunity of hearing, and to pass appropriate orders on merits and in accordance with law.

5. With the above direction, this Writ Petition stands disposed of. 3/5

Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
