ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 1/4

2. The present writ petition is filed praying for a writ of Mandamus to direct the 2nd respondent to register the sale deed presented by the petitioner, without insisting the original document in Document No.1641/2011.

It is submitted by the learned counsel for petitioner that petitioner purchased the subject property comprised in Survey Nos.237/3 and 245/10 measuring an extent of 4 ares and 06.47 ares total 26 cents in Patta Nos.4804 and 4805 respectively situtated at Sayanavaram Village, Nemili Taluk, Ranipet District, from Velu and Rajagopal for valuable sale consideration vide Document No.1641/2011 dated 08.07.2011. While so, petitioner decided to sell the property and presented the sale deed for registration before the 2nd respondent, however, it is stated that the same was refused registration on the ground of non-production of parent deed. Therefore, petitioner has filed the present writ petition seeking registration of sale deed without insisting the original parent documents.

4. At the outset, it is submitted by Mr.Abishek Murthy, learned Government Advocate for respondents that there is no refusal slip and that sale deed was infact not presented for registration. He would further submit that petitioner may present the sale deed for registration, if any sale deed is 2/4

presented, the same would be registered if it is otherwise in order. If for any reason, the same is sought to be rejected, the appropriate authority would issue refusal check slip/order assigning reasons for such refusal. Agreed to by the learned counsel for petitioner.

5. In view thereof, the writ petition stands disposed of. It is open to the petitioner to present the sale deed for registration, the concerned respondent shall consider and register the document if it is otherwise in order, if for any reason the registering authority finds that the registration ought to be refused, the same shall be done after assigning reasons. It is made clear that this Court has not expressed any views on merits and it is open to the concerned respondent to consider the sale deed as and when presented for registration on its own merits and in accordance with law. No costs.
