Transfer civil miscellaneous petition filed under Section 24 of CPC, seeking to withdraw HMPO.No.930 of 2021 on the file of the Family Court, Madurai and transfer the same to the Family Court, Villupuram.

O R D E R

The petitioner / wife seeks transfer of HMOP.No.930 of 2021 on the file of the Family Court at Madurai to the Family Court, Villupuram. Transfer is sought for mainly on the ground of convenience, since the wife is a resident of Villupuram. The husband is shown to be a resident of Madurai. 2.Mr.Azhagu Raman, learned counsel appearing for the respondent / husband would submit that transfer to a Family Court would cause more inconvenience to the husband as he has travel to travel from Madurai, if the case is transferred to Villupuram. He would also add that there have been various police complaints, which have created a very serious apprehension in his mind regarding his safety, if he is to travel to Villupuram.

3.Considering the above and convenience of both the parties, HMOP.No.930 of 2021 on the file of the Family Court, Madurai is withdrawn and transfered to the Sub-Court, Ulundurpet to be tried and disposed of in accordance with law. Being a Sub-Court, the parties will not be required to appear in person and they can represent though counsel.

4.This transfer civil miscellaneous petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
