..Respondent PRAYER: Criminal Miscellaneous Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to modify the condition imposed in the order dated 30.04.2026 made in Crl.O.P.No.11322 of 2026 directing the petitioner to deposit a sum of Rs.5,00,000/- as a condition for his release on bail and consequently dispense with the said deposit condition in its entirety and enlarge the petitioner on bail subject to the remaining conditions imposed by this Court.

ORDER

This Criminal Miscellaneous Petition has been filed seeking modification of the condition imposed in the order dated 30.04.2026 passed in Crl.O.P.No.11322 of 2026, directing the petitioner to deposit a sum of

Rs.5,00,000/- as a condition for his release on bail and consequently to dispense with the said deposit condition in its entirety and enlarge the petitioner on bail subject to the remaining conditions.

2. The learned counsel appearing for the petitioner would submit that the petitioner continues to be behind bars and finds it extremely difficult to raise the required funds. However, the petitioner has filed an affidavit undertaking to deposit a sum of Rs. 1,00,000/- instead of the directed amount of Rs. 5,00,000/-

Considering the submissions made the learned counsel for the petitioner and the nature of the offence, this Court is inclined to modify the condition imposed in paragraph No.7 of the order dated 30.04.2026 made in Crl.O.P.No.11322 of 2026. Accordingly, the condition that "Accordingly, the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Crime No.87 of 2026 and on such deposit, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court at Pallavaram and on further conditions that:" is modified to the effect that "Accordingly, the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.87 of 2026 and on such deposit, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only)

with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court at Pallavaram and on further conditions that:. The other conditions imposed earlier shall remain unaltered.
