ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus directing the respondents to rectify the measurement error in Patta No.957 FMB sketch and other revenue records as per the Original Settlement Register (OSR) by considering petitioner's representations dated 13.07.2023, 24.09.2024 and 16.04.2025.

It is submitted by the learned counsel for petitioner that property comprised in Survey No.366, measuring an extent of 5 acres and 42 cents situated at Chettypalayam Village, Madakkarai Taluk, Coimbatore District was acquired by the by way of registered sale deed from Vaiyapuri Gounder, Nanjappa Gounder, Arunachalam and Ramasamy Gounder measuring an extent of 2 acres and 14 cents vide Document No.4971 of 1987 dated 27.10.1987. It is stated that petitioner is the owner of the property and patta has also been issued in Patta No.957. Petitioner had applied for survey of the property and had come 2/6
to know that there was a measurement error in Patta No.957, FMB Sketch and other revenue records wherein the extent of land is mentioned as 4 acre 95 cents instead of 5 acres and 42 cents. Petitioner submitted a representation to the 1st respondent seeking survey and rectification of errors in patta on 13.07.2023, who in turn forwarded the same to the 2nd and 3rd respondents vide proceedings dated 27.07.2023, which is stated to be kept pending. Aggrieved, petitioner has filed the present writ petition.

At the outset, it is submitted by Mr.P.Sathish, learned Additional Government Pleader for respondents that pursuant to the above representation submitted by petitioner, the District Revenue Officer directed the Tahsildar to conduct an enquiry and submit a report. It is further submitted by the learned counsel for respondent that 3rd respondent would conduct enquiry and forward the report to the District Revenue Officer who on receiving the report would pass appropriate orders after providing a reasonable opportunity of hearing to petitioner and other interested parties within a time frame to be fixed by this Court. Agreed to by the learned counsel for petitioner.
5. In view thereof, the writ petition stands disposed of with a direction to the 3rd respondent to conduct enquiry and forward the report to the District 3/6
Revenue Officer who on receiving the report shall pass appropriate orders after providing a reasonable opportunity of hearing to petitioner and other interested parties within and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner, adjacent land owners and any other interested persons/stake holders, including rival claimants, if any, within a period of 12 weeks from the date of uploading of web copy without waiting for receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the matter and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. No costs.
