ORDER

This writ petition has been filed to direct the second respondent to redetermine the compensation awarded to the petitioners' lands acquired at Karasur Revenue Village in Award No.2/2008, to a sum of Rs.21,261/- per Are, based on the petitioners' application under Section 28A of the Land Acquisition Act 1894 dated 21.03.2019, pursuant to the enhanced compensation award passed in LAOP No.110 of 2012 on the file of II Additional District Judge, Puducherry.

2. Mr.V.Vasanthakumar, learned Additional Government Pleader (Puducherry) takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.

The case of the petitioners is that the first respondent herein acquired the lands in the Sedarapet and Karasur Revenue Village of Villianur Taluk for the purpose of setting up of "Special Economic Zone" by invoking the urgency provision under Section 17(4) of the Land Acquisition Act, which includes petitioners' land. Since the final compensation determined by the third respondent was too low, many lands owners preferred an application, seeking enhancement of compensation. By which, one Mrs.S.G.Jothy, one of the land owners preferred a reference application in LAOP No.110 of 2012, seeking enhancement of compensation and the same was allowed by enhancing the compensation from Rs.12,352/- per are to Rs.21,261/- per are, along with 30% solatium and 12% additional market value. By virtue of the said order, petitioners herein made an application dated 21.03.2019, before the second respondent seeking to re-determine the compensation awarded to their lands. However, till date, the same was not considered. Hence, the petitioner has come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioners submitted that, it would suffice, if this Court issues direction to the second respondent to consider the petitioners' application dated 21.03.2019.

5. Learned Additional Government Pleader appearing for the respondents submitted that the petitioners' application dated 21.03.2019 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

7. Considering the limited relief sought for by the learned counsel for the petitioners, this Court without going into the merits of the case, directs the second respondent to consider the petitioners' application dated 21.03.2019, after conducting enquiry, within a period of eight weeks from the date of receipt of a copy of this order.
