PRAYER: Criminal Miscellaneous Petition has been filed under Section 528 of BNS Act, to modify the condition that "para 8 imposed in Crl.O.P.No.3082 of 2025 dated 04.04.2025" on the file of this Court. For Petitioner :

ORDER

This petition has been filed seeking to modify the condition imposed in para 8 of Crl.O.P.No.3082 of 2025 dated 04.04.2025.

2. The learned counsel appearing for the petitioner submits that this Court by order dated 04.04.2025 in Crl.O.P.No.3082 of 2025 granted Bail to the petitioner with the conditions that "8.Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties, one from blood relative and other from local surety each for a like sum to the satisfaction of the learned Judicial Magistrate Court No.II, Salem". He further submits that though the bail was granted by this Court on 04.04.2025, the petitioner is unable to execute the sureties since he is from Odisha. Hence, he seeks for modification of the conditions.

3. Learned Government Advocate (Crl.Side) appearing for the respondent submits that the petitioner hails from the State of Odisha, and if granted modification, he will abscond. Hence, he strongly opposed the grant of modification to the petitioner.

Considering the facts and circumstances of the case, this Court modifies the above conditions to the effect that "8.Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, one from family member and other from local surety each for a like sum to the satisfaction of the learned Judicial Magistrate Court No.II, Salem".

5. With the above observations and directions, this Criminal Miscellaneous Petition is ordered. The other conditions shall remain unaltered.
