Respondents Prayer: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to direct the respondents herein to permit the Athanoorpatty Villagers to conduct Chariot and other festival with respect of Arulmigu Sri Ayyanarappan Wooden Statute Temple, existing at Athanoorpatty Pudhur Village on 23.08.2019 and 24.08.2019 as per the terms and conditions of the Panchayet Muchalika dated 01.07.2011 and to provide police protection by considering the representation of the petitioner herein dated 18.07.2019.

ORDER

This petition has been filed for a direction to the respondent police to permit the petitioner to conduct the temple festival and to give police protection. 2.The learned Additional Public Prosecutor on instructions submitted that there is a dispute with regard to conducting of the festival between two parties and for the last ten years, the festival has not been https://hcservices.ecourts.gov.in/hcservices/

conducted. The learned counsel submitted that the dispute has been referred to the Tahsildar, Valapady, under Section 145 of Cr.P.C.

3.The learned counsel for the petitioner submitted that the festival can be conducted even by the revenue authorities and the petitioner is willing to co-operate for the same and also provide the necessary funds to conduct the festival.

4.Taking into consideration the facts and circumstances of the case, there shall be a direction to the Tahsildar, Valapady to enquire the parties and take steps to conduct the festival this year by permitting both the parties to participate in the same. The Tahsildar shall also take the necessary assistance from both the parties, to ensure that the festival is conducted peacefully. If the revenue officials undertake to conduct the festival this year, the respondent police namely, the 4th, respondent shall provide necessary police protection for the festival.

5.This Criminal Original Petition is disposed of with the above directions.
