ORDER

This Criminal Revision Case has been filed as against the order dated 14.05.2025 passed in CMP No.66 of 2025 on the file of the District Munsif-cum-Judicial Magistrate, Yercaud, thereby dismissing the petition

seeking a direction under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

A perusal of the complaint lodged by the petitioner reveals that, on 30.08.2023, some private persons had cut down trees situated in Survey No.13/2, Kottachedu Village, Servarayan Forest Range, Yercaud Taluk, Salem District, which is classified as Government poramboke land. Further, the petitioner had also filed a writ petition before this Court in W.P.No.25002 of 2024 seeking a direction to the authorities concerned to take appropriate action for illegal felling of trees in Survey No.13/2 of Kottachedu Village, Servarayan Forest Range, Yercaud Taluk, Salem District, which is pending. It is further seen that the petitioner lodged the present complaint after a delay of one and a half years from the date of the alleged occurrence. Therefore, the Trial Court rightly dismissed the petition seeking direction under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

4. In view of the above, this Court finds no infirmity or illegality

in the order dated 14.05.2025 passed in CMP No.66 of 2025 on the file of the District Munsif-cum-Judicial Magistrate, Yercaud. Accordingly, this Criminal Revision Case stands dismissed.
