Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify a condition Para 8(b) imposed by this Hon'ble Court Dated 16.09.2021 in Crl.O.P.No.17030 of 2021 in CRIME No.522/2021 on the file of the respondent police and instead of Rs.5,00,000/- to Modify and reduce the amount.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.T.K.SATHIASEELAN, Advocate for the Petitioner and of MR. A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to modify the condition imposed by this Court vide order dated 16.09.2021 in Crl.O.P.No.17030 of 2021, wherein, the petitioner shall make a non refundable deposit of Rs.1,00,000/- through demand draft in favour of The Director, Cancer Institute(WIA), Adayar for treating Cancer patients; another demand draft for a sum of Rs.2,00,000/- in favour of The Chief Educational Officer, Salem District, for the rehabilitation and improvement of the basic needs of the Government Schools in the concerned District and further make a non-refundable deposit of Rs.2,00,000/- in favour of The Chief Educational Officer, Villupuram

District, for the rehabilitation and improvement of the basic needs of the Government Schools in the concerned District. The above contribution is made without prejudice to his defence before the trial court.

2. This court granted Anticipatory bail to the petitioner on 16.09.2021 imposing the condition that he should deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs Only). Since the petitioner on his own volition agreed to deposit the said amount and was granted anticipatory bail. However, now the petitioner filed the modification petition to modify the conditions imposed in Crl.O.P.No.17030 of 2021 dated 16.09.2021.

3. In view of the above, this Court is of the opinion that the amount imposed by this Court is based on petitioner representation and no interference is required. Accordingly, this Criminal Miscellaneous petition is dismissed. However, time is extended by a further period of two weeks to deposit the amount.
