ORDER
The petitioners seek Succession Certificate in favour of the first petitioner in respect of the securities held by Late.Muthuswamy Subramanian, who died intestate on 24.08.2012.
2. The petitioners are the children of the deceased Muthuswamy 1/6
Subramanian. The petitioners are the only surviving legal heirs of the deceased Muthuswamy Subramanian, since the wife of the deceased predeceased him.
3. The first petitioner has been examined as PW1. He has produced the death certificate and legal heirship certificate of the late.Muthuswamy Subramanian as ExP1 and ExP2. A perusal of Ex.P2, shows that the petitioners are the children of the deceased and the only surviving legal heirs of the deceased. A paper publication has been made and no objections have been received.
4. The petitioners 2 to 6 have given consent affidavits to grant a succession certificate in favour of the first petitioner.
5. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioners are entitled to the relief.
6. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the first Petitioner, in respect of 2/6
the securities and to receive the dividends thereon and negotiate and transfer the shares mentioned in the schedule to the petition. Index :Yes/No Speaking order: Yes/ No Petitioner's witness:
