CORAM

THE HONOURABLE MR JUSTICE P.B. BALAJI CRP.No.2613 of 2025 S.P.Nachiappan ... Petitioner Vs.

S.Venkatesan ... Respondent PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, to direct the Principal District and Sessions Judge, Chengalpattu, to dispose of E.P.No.142 of 2022 in O.S.No.11876 of 2010 pending on its file. For Petitioner : Mr.N.Damodaran

ORDER

The Civil Revision Petition has been filed to direct the Principal District and Sessions Judge, Chengalpattu, to dispose of E.P.No.142 of 2022 in O.S.No.11876 of 2010 pending on its file.

2.Heard the learned counsel for the petitioner. 1/4

3.The decree holder, who has been attempting to execute the decree in O.S.NO.11876 of 2010, has come forward with the present revision, seeking expeditious disposal of the said execution petition in E.P.No.142 of 2022 on the file of the Principal District and Sessions Court, Chengalpattu. 4.Considering the limited relief sought for in the revision, notice to the respondent is dispensed with. The petitioner admittedly obtained a decree in O.S.No.11876 of 2010 and has put it to execution in E.P.No.142 of 2022. It is seen that the judgment debtors have taken out as many as 18 applications and have been unsuccessful in 17 of them. Revisions were also filed before this Court, challenging some of the orders in the interlocutory stage and have also been dismissed. In fact, the execution petition itself has been filed to execute an award that has been passed by the Lok Adalat Court on 08.02.2020.

5.In the light of the above and considering the fact the EP itself is of the year 2022 and the suit has been filed originally in the year 2010, I hereby direct the Principal District and Sessions Court, Chengalpattu, to dispose of E.P.No.142 of 2022, on merits and in accordance with law, expeditiously at 2/4

any rate on or before 31.10.2025.

6.With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs.
