ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of Mandamus to direct the respondents to cancel the legal heir certificate dated 23.09.2025 and consequently issue a fresh legal heir certificate in accordance with the law in view of petitioner's representation dated 10.03.2026.

3. It is submitted by the learned counsel for petitioner that petitioner was married to one Sivagami who was employed as a Teacher and there were no children out of the wedlock. It is further submitted that petitioner's wife died on 17.08.2022, in a road accident. While so, petitioner came to know that a legal heir certificate came to be issued wherein the following persons were shown as legal heirs of deceased along with petitioner: i) Monisha ii) Vengatesh and iii) Usha 3.1. He would submit that petitioner is the sole legal heir and therefore petitioner submitted a representation on 10.03.2026 for cancellation of the legal heir certificate wherein the names of Usha, Vengatesh and Monisha

was included allegedly on the basis of fraudulent documents.

Learned counsel for respondents would submit that in terms of G.O.Ms.No.478, Revenue and Disaster Management, Revenue Administration Wing, RA-3(2) Section, dated 29.09.2022, more particularly paragraph 10, provides that legal heir certificate obtained by furnishing false information/ suppression of materials, the same is liable to be cancelled by the authority. He would thus submit that petitioner's representation dated 10.03.2026 would be considered and appropriate orders would be passed after issuing notice to the petitioner, Usha, Vengatesh, Monisha and other interested parties.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondents to consider the representation dated 10.03.2026 on its own merits and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioner, Usha, Vengatesh, Monisha and any other interested persons within a period of eight (8) weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
