Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records relating to the award of the 1st respondent dated 1.11.2000 in IDNo.320/99 and quash the same.

O R D E R

The relief sought for in this writ petition is to quash the award dated 01.11.2000 in I.D.No.320 of 1999 passed by the First Respondent.

2. The Petitioner/Co-operative Society had engaged the Second Respondent as a salesman from 21.05.1996 and he was terminated from service on 21.05.1999, for which he raised an industrial dispute bearing I.D.No.320 of 1999 before the First Respondent. The First Respondent by award dated 01.11.2000, set aside the order of termination and directed the Petitioner to reinstate the Second Respondent in service with continuity of service, but without backwages. Aggrieved by the said award, the Petitioner has filed this writ petition.

3. It is represented by Mr.K.V.Shanmuganathan, learned Counsel appearing for the Second Respondent that after filing of this writ petition, the Petitioner had entered into a https://hcservices.ecourts.gov.in/hcservices/

settlement with the Second Respondent, and after approval by resolution No.311 / 2016 dated 22.08.2016 passed by the Board of Director, of the Petitioner, the Second Respondent was reinstated in service, and he has been working thereafter as a clerk. A memo dated 03.07.2018 has also been filed by the counsel for the Second Respondent to that effect.

4. In view of the above submission made by the learned counsel for the Second Respondent, which is accepted by the learned counsel for the Petitioner, nothing survives for adjudication in the matter. Recording the same, the Writ Petition is disposed of. No costs.
