This application has been filed for clarification of paragraph 4 of the judgment passed in C.S.No.167 of 2023 dated 18.12.2023.

2. The learned counsel appearing for the applicant submitted that in the judgment dated 18.12.2023, it is recorded that as the parties are agreeing to go for a fresh election by the independent person, whether the new builder has to be identified by the Advocate Commissioner on the basis of election or mere selection by the Advocate Commissioner.

3. In the judgment in C.S.No.167 of 2023, dated 18.12.2023, in paragraph No.4, it is inadvertently recorded as 'fresh election' instead of 'fresh selection'. Hence, it is made clear that selection to be made only by the Advocate Commissioner. Accordingly, the matter is clarified.
