The application has been filed seeking permission to file additional documents.
2. These documents are electronic Mails, which have been purportedly sent by the defendant to the plaintiffs.
3. Today, on instructions, it is represented by the learned counsel for the defendant that the plaintiffs had sent replies to the electronic mails.
4. However, this stand is controverted by the learned counsel for the plaintiffs.
5. These are issues which can be examined only during the course of trial and can be examined only if these documents are taken on record.
6. Subject to admissibility, proof and relevancy, the documents are taken on record.
7. During the course of cross examination of defence witness, if the reply sent by the plaintiffs are admitted by the witness they may be marked. If they are not so admitted then, the plaintiffs may file them as additional documents on their side.
8. The application stands allowed.
